Terms of Payment
Subject to the approval of the Sellers credit department, terms are C.O.D. If the customer establishes credit with the seller then the terms are net 30 days, from the sellers invoice data. All accounts with credit must give a signed visa authorization form for payment in case the cheque is not received in time to pay the outstanding invoices. If any payment owed to the seller is not paid when due, it shall bear interest at 2% per month (24% annually calculated monthly, will be charged on every balance, which is past due. Seller shall have the right among other remedies either to terminate the agreement or to suspend further performance under this and/or other agreements with the Buyer in the event Buyer fails to make any payment when due. Buyer shall be liable for the expenses, including attorney's fees, and court costs and employees costs relating to the collection of accounts.
Ganiva Trim Carpentry Ltd. will leave material at the job site without a signature, if none is available. The purchaser must accept the invoice as proof of delivery.
All products sold by Ganiva Trim Carpentry Ltd. will remain the property of Ganiva Trim Carpentry until paid in Full.
For settlement of delinquent or bankrupt accounts, we reserve the right to repossess any or all products.
Shipment and Delivery
Shipments are F.O.B. Seller's shipping point. Any claims for shortages or damages suffered in transit shall be submitted by the Buyer in writing, directly to Ganiva Trim within 48 hours. While the seller will use all reasonable commercial efforts to maintain the delivery date acknowledged or quoted by seller, all shipping dates are approximate.
Returns, Claims, and Damages
All returned items must be authorized in advance. There will be a 20% restocking charge for goods returned. All orders of special size, thickness, face cut or non-stock items are not cancellable once ordered and accepted by Ganiva Trim Carpentry Ltd. The deposits on these items are not refundable. Ganiva Trim Carpentry reserves the right not to take back any poroduct that is damaged by handling, or improper storage. There are no returns on pieces under 4ft long or cut pieces. There are no returns on items installed or finished. Due to the nature of Plywoods they are not returnable.
Ganiva Trim Carpentry Ltd. assumes no responsibility for the damage of goods in transit by the purchaser.
Damaged material must be identified and reported to Ganiva Trim no later than two working days after the material is received. The damaged material must not be used or cut. If Ganiva Trim Carpentry Ltd. agrees to refund the client the most the client can get refunded is the cost of the product.
Any woods and plywood that are purchased from our company are in, as is condition. Ganiva Trim Carpentry Ltd. is not responsible for any improvements done to the material purchased. We are not responsible for any costs incurred by the purchaser for labour, finishing of the product, increased time costs to any job, or removal of any product sold by our company for any reason. Customers must ensure the product they are using is SUITABLE before they install it.
Returns must be made within 30 days of the original shipment date.
Excuse of Performance
Seller shall not be liable for delay in performance or for non performance due to acts of God, acts of Buyer, war, riot, fire, flood, other severe weather sabotage, or epidemics, strikes of labor disturbances; governmental requests restriction, law, regulations, order or actions; unavailability of or delay in transportation; default of suppliers.
